释义	赌博罪是指以营利为目的，聚众赌博或者以赌博为业的行为。根据我国《刑法》第三百零三条规定，以营利为目的，聚众赌博、开设赌场或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。此外，根据最高人民法院、最高人民检察院《关于办理赌博刑事案件具体应用法律若干问题的解释》第五条规定，实施赌博犯罪，有下列情形之一的，依照刑法第三百零三条的规定从重处罚：(一)具有国家工作人员身份的(二)组织国家工作人员赴境外赌博的(三)组织未成年人参与赌博，或者开设赌场吸引未成年人参与赌博的。
