战时拒绝、逃避服役罪既遂法院一般判刑如下:处二年以下有期徒刑或者拘役。本罪对于犯罪时间有特殊要求，要求为“战时”，非“战时”不构成本罪。“战时”是指国家宣布进入战争状态、部队受领作战任务或者遭敌突然袭击时、部队执行戒严任务或者处置突发性暴力事件时。
法律依据:《《中华人民共和国刑法》》第四百五十一条
【战时的概念】本章所称战时，是指国家宣布进入战争状态、部队受领作战任务或者遭敌突然袭击时。
部队执行戒严任务或者处置突发性暴力事件时，以战时论。
