释义	法律分析：刑罚的消灭，是指由于出现法律规定的原因，致刑法对特定犯罪人的刑罚权利灭失。刑罚消灭的事由有刑罚裁量权和刑罚处罚权的消灭两种。刑罚裁量权的消灭事由有以下三种：1、犯罪人在判决前死亡；2、自诉案件的自诉人撤诉；3、犯罪人在判决前获大赦。法律依据：《中华人民共和国刑法》第七十六条对宣告缓刑的犯罪分子，在缓刑考验期限内，依法实行社区矫正，如果没有本法第七十七条规定的情形，缓刑考验期满，原判的刑罚就不再执行，并公开予以宣告。
