2023年嫖娼拘留多久 |

法律分析：如果已满14周岁未满16周岁不予执行行政拘留，已满16周岁未满18周岁初次触犯治安管理处罚法，不会被执行行政拘留，但是会被执行行政罚款；70周岁以上的也不会拘留。如果不符合以上规定，应当既拘留，又罚款。原则就是10日以上15日以下，并可以处5000元罚款。
嫖娼是指不特定的异性之间或者同性之间以金钱、财物为媒介发生性关系(不包括推油等按摩服务)(包括口淫、手淫、鸡奸等)的行为。
行为人明知是不满十四周岁的幼女而与其发生性关系，不论幼女是否自愿，均应依照以强奸罪定罪处罚;行为人确实不知对方是不满十四周岁的幼女，双方自愿发生性关系，未造成严重后果，情节显著轻微的，不认为是犯罪。
明知自己患有梅毒、淋病等严重性病卖淫、嫖娼的，处5年以下有期徒刑、拘役或者管制，并处罚金。
1、如果行为人明知自己患有严重性病，仍与他人恋爱、姘居、通奸的，均不构成本罪。需有营利目的或者放任传播而进行卖淫、嫖娼为目的。
2、明知自己患有严重性病，出于伤害他人、使他人传染上性病的故意，与他人发生性关系，致使他人传染上性病的，不能定传播性病罪，情节严重的应以故意伤害罪论处。
法律依据：《中华人民共和国治安管理处罚法》 第六十六条 卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。 在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
