第十条 业主或工程总承包企业未按合同约定与建设工程承包企业结清工程款，致使建设工程承包企业拖欠农民工工资的，由业主或工程总承包企业先行垫付农民工被拖欠的工资，先行垫付的工资数额以未结清的工程款为限。
第十一条 企业因被拖欠工程款导致拖欠农民工工资的，企业追回的被拖欠工程款，应优先用于支付拖欠的农民工工资。
