法律分析：劳动者是和公司签订合同，一般应加盖公司公章，人事部门是专门主管人事合同的签订履行的，因此加盖人事章也应该认定为是有效的，法律规定是签字、盖章;有其一就可以，如果是签字应是法定代表人的签字，如果公司章程有规定，其他人经法定代表人授权也可以有效。
法律依据：《中华人民共和国劳动合同法》 第十六条 劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。
