释义	无效。在订立挂靠协议时，实际的主体并不具有订立所谓挂靠合同的主体资格，是通过挂靠的方式取得资质,从而签订买卖合同，同时也不是合同相对方的真实意思表示，所以，挂靠合同违反法律强制性规定，是无效的合同。法律依据《民法典》第一百五十三条，违反法律、行政法规的强制性规定的民事法律行为无效。但是，该强制性规定不导致该民事法律行为无效的除外。违背公序良俗的民事法律行为无效。
