一、二手房买卖全权委托有效吗
1、二手房买卖全权委托书是当事人自愿签订的，当事人具有民事行为能力，并且协议内容不违反的，就具有法律效力。
2、法律规定：《中华人民共和国民法典》
第一百四十三条【民事法律行为有效的条件】具备下列条件的民事法律行为有效：
(一)行为人具有相应的民事行为能力；
(二)意思表示真实；
(三)不违反法律、行政法规的强制性规定，不违背公序良俗。
二、二手房买卖合同必须约定定金吗
事实上，二手房买卖合同的定金不是必须约定的，是否需要支付定金关键在于双方当事人的约定。
约定了定金后，买受人交付全款时，定金将抵作价款或者收回。并且，交付购房定金后，若是出现违约不履行合同约定的情况，将会产生以下的法律后果：
1、买受人交付定金后又不履行约定，交付剩下的房款的，将损失定金利益，不能拿回来；
2、出卖人交付定金后又不履行约定，需要双倍返还定金。
另外，现在人达成房屋买卖合同，约定定金已经变成普遍现象，所以若是在二手房买卖合同中约定了定金，要注意以下几点：
1、约定定金时，要以书面形式，可以签订定金合同或是在二手房买卖合同中约定定金条款；
2、约定定金时，对定金数额可以协商，但是按规定不得超过房价款的20%，超出部分不受定金罚则的约束，只能作为预付款。
