释义	根据本条和第115条的规定，犯放火罪的，尚未造成严重后果的，处三年以上十年以下有期徒刑；致人重伤、死亡或使公私财产遭受重大损失的，处十年以上有期徒刑、无期徒刑或死刑。尚未造成严重后果包括两种情况：一是放火行为没有造成任何实际损害后果；二是放火行为造成了一定的实际损害后果，但并不严重。在这两种情况下，只能根据本条的法定刑处罚。只有当放火行为造成他人重伤、死亡或者使公私财产遭受重大损失时，才能根据本法第115条的法定刑处罚。法律依据《中华人民共和国刑法》第一百一十五条
