释义	当事人超越经营范围订立的合同，人民法院并不因此认定合同无效。但违反国家限制经营、特许经营以及法律、行政法规禁止经营规定的除外。我国法律规定，具备下列条件的民事法律行为有效：（一）行为人具有相应的民事行为能力；（二）意思表示真实；（三）不违反法律、行政法规的强制性规定，不违背公序良俗。【本文关联的相关法律依据】《民法典》第五百零五条，当事人超越经营范围订立的合同的效力，应当依照本法第一编第六章第三节和本编的有关规定确定，不得仅以超越经营范围确认合同无效。
