释义	法律分析：在建工程抵押时，土地使用权应与在建工程一并抵押，不能剥离抵押。法律依据：《城市房地产抵押管理办法》第十条以两宗以上房地产设定同一抵押权的，视为同一抵押房地产。但抵押当事人另有约定的除外。第十一条以在建工程已完工部分抵押的，其土地使用权随之抵押。第十二条以享受国家优惠政策购买的房地产抵押的，其抵押额以房地产权利人可以处分和收益的份额比例为限。
