工程未验收擅自使用要负什么责任

法律分析：
发包人擅自使用未经竣工验收工程，视为其认可工程质量合格或同意对工程发生的质量问题自担责任，放弃了对工程质量缺陷提出抗辩的权利，再以其使用部分工程质量不符合约定为由主张权利的，不应得到支持。
法律依据：
《中华人民共和国建筑法》 第六十一条 交付竣工验收的建筑工程，必须符合规定的建筑工程质量标准，有完整的工程技术经济资料和经签署的工程保修书，并具备国家规定的其他竣工条件。
建筑工程竣工经验收合格后，方可交付使用；未经验收或者验收不合格的，不得交付使用。
