问题	税务行政处罚听证申请时限
释义	要求听证的当事人，应当在《税务行政处罚事项告知书送达后3日内向税务机关书面提出听证;逾期不提出的，视为放弃听证权利。当事人因不可抗力或者其他特殊情况耽误法定听证期限的，在障碍消除后5日内，可以提出听证，如其理由正当，领导岗应当准许。对应当进行听证的案件，税务机关不组织听证，行政处罚决定不能成立;当事人放弃听证权利或者被正当取消听证权利的除外。
