释义	法律分析：卖淫嫖娼是指不特定的异性之间或者同性之间以金钱、财物为媒介发生性关系的行为。行为主体之间主观上已经就卖淫嫖娼达成一致，已经谈好价格或者已经给付金钱、财物，并且已经着手实施，但由于其本人主观意志以外的原因，尚未发生性关系的者已经发生性关系，但尚未给付金钱、财物的，都可以按卖淫嫖娼行为依法处理。法律依据：《中华人民共和国刑法》第三百五十八条组织、强迫他人卖淫的，处五年以上十年以下有期徒刑，并处罚金节严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。
