释义	根据《著作权法》第五十条规定：著作权人或者与著作权有关的权利人有证据证明他人正在实施或者即将实施侵犯其权利的行为，如不及时制止将会使其合法权益受到难以弥补的损害的，可以在起诉前向人民法院申请采取责令停止有关行为和财产保全的措施。第五十五条规定：著作权纠纷可以调解，也可以根据当事人达成的书面仲裁协议或者著作权合同中的仲裁条款，向仲裁机构申请仲裁。当事人没有书面仲裁协议，也没有在著作权合同中订立仲裁条款的，可以直接向人民法院起诉。法律依据《著作权法》第五十条、第五十五条
