释义	当事人不服一审判决书的，应在判决书送达之日起15日内向上一级人民法院提起上诉。上诉应提交上诉状，上诉状向原审人民法院提出，提交副本一份。原审人民法院收到上诉状，应当在5日内将上诉状副本送达对方当事人，对方当事人在收到之日起15日内提出答辩状，人民法院应当在收到答辩状之日起5日内将副本送达上诉人，对方不答辩的不影响案件的审理。法律依据：《中华人民共和国民事诉讼法》第一百六十四条当事人不服地方人民法院第一审判决的，有权在判决书送达之日起15日内向上一级人民法院提起上诉。
