释义	犯了非法捕捞水产品罪量刑处罚为处三年以下有期徒刑、拘役、管制或者罚金。单位犯本罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照自然人犯罪的规定处罚。未造成严重危害后果或者偶尔违反捕捞许可证关于作业类型、场所、时限等方面的规定进行捕捞的，不构成本罪。【法律依据】《中华人民共和国刑法》第三百四十条违反保护水产资源法规，在禁渔区、禁渔期或者使用禁用的工具、方法捕捞水产品，情节严重的，处三年以下有期徒刑、拘役、管制或者罚金。
