释义	法律分析：一般不能起诉小三。但存在明知他人有配偶而与之结婚的行为，处二年以下有期徒刑或者拘役，承担刑事责任。重婚罪属于人民法院直接受理的自诉案件，人民检察院没有提起公诉，被害人有证据证明的可以提起自诉。即使与小三达成分手协议，没有付分手费，小三也无权起诉，因为分手协议是无效的。了分手费付反悔的，也是无权要回来的，因为这样的情况诉至法院，法院是不予支持的。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
