释义	只有十四周岁以上的未成年人在犯了故意杀人罪时才需要承担刑事责任，而且应当从轻或减轻处罚，具体判多少年还要视犯罪情节而定。另外还需要注意的是，未成年人犯罪，即使情节特别严重，但是也是不能判处死刑的。法律依据: 《中华人民共和国刑法》第十七条已满十四周岁不满十六周岁的人，犯故意杀人、故意伤害致人重伤或者死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投放危险物质罪的，应当负刑事责任。已满十四周岁不满十八周岁的人犯罪，应当从轻或者减轻处罚。
