问题	是职务侵占罪吗？
释义	职务侵占罪并不属于职务犯罪。职务犯罪主要是指掌握一定管理、支配公共财产、人事关系等多种实权的国家公务人员滥用职权、谋取私利、侵犯公共利益的高层次、高智商犯罪，其本质特征是以权谋私、权钱交易。主要表现是贪污贿赂、挪用公款等经济犯罪和渎职侵权犯罪，是腐败现象最突出的表现。职务侵占罪(刑法第271条)，是指公司、企业或者其他单位的人员，利用职务上的便利，将本单位财物非法占为己有，数额较大的行为。从上面两者的概念中不难看出，职务侵占罪并不属于职务犯罪。具体而言，两者最大的区别在于主体的不同。
