释义	没有离婚,只同居的话,一般算婚外恋和出轨。根据《中华人民共和国刑法》第二百五十八条规定，重婚罪是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。所谓明知他人有配偶而与之结婚的，是指本人虽无配偶，但明知对方有配偶，而故意与之结婚的(包括登记结婚或者事实婚)。此种行为是有意破坏他人婚姻的行为。和第三者没离婚同居算不算重婚罪，主要看同居行为是否构成事实婚姻，如果已经构成事实婚姻，那么和第三者没离婚同居算重婚罪。
