释义	法律分析: 长期夜班不违反劳动法，但是劳动合同约定了不上夜班或者劳动者属于哺乳未满一周岁婴儿的女职工除外。我国实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度。用人单位应当保证劳动者每周至少休息一日。法律依据: 《中华人民共和国劳动法》第六十三条不得安排女职工在哺乳未满一周岁的婴儿期间从事国家规定的第三级体力劳动强度的劳动和哺乳期禁忌从事的其他劳动，不得安排其延长工作时间和夜班劳动。
