释义	在法律上缓刑就等于不用坐牢，缓刑全称暂缓量刑，也称为缓量刑，是指对触犯刑律，经法定程序确认已构成犯罪、应受刑罚处罚的行为人，先行宣告定罪，暂不执行所判处的刑罚。【法律依据】《刑法》第七十三条，拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于二个月。有期徒刑的缓刑考验期限为原判刑期以上五年以下，但是不能少于一年。缓刑考验期限，从判决确定之日起计算。
