释义	法律分析：只有明确了侵权责任，才能有效地教育不法行为人，引导人们正确行为，在民事活动中约束自己的行为；才能鼓励行为人采取积极的预防措施，减少侵权行为，努力避免和减少损害的发生。法律依据：《中华人民共和国民法典》第一千一百六十五条行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
