释义	法律分析：犯本罪的，处二年以下有期徒刑或者拘役，并处或者单处罚金。其立案标准： (1)给他人造成的直接经济损失数额在五十万元以上的； (2)虽未达到上述数额标准，但是具有下列情形之一的：严重妨害他人正常生产经营活动或者导致停产、破产的；造成恶劣影响的。法律依据：《中华人民共和国刑法》第二百二十一条损害商业信誉、商品声誉罪是指捏造并散布虚伪事实，损害他人的商业信誉、商品声誉，给他人造成重大损失或者有其他严重情节的行为。犯本罪的，处二年以下有期徒刑或者拘役，并处或者单处罚金。
