释义	法律分析：被处罚人对行政机关作出的行政处罚决定不服的，可以向人民法院提起行政诉讼，如果行政机关提供的证据，证明处罚是依法依规的，原告有可能败诉，行政诉讼后法院判决变更的，不得加重原告的义务或者减损原告的权益，所以是不能加重对原告的处罚。法律依据：《中华人民共和国行政诉讼法》第七十七条行政处罚明显不当，或者其他行政行为涉及对款额的确定、认定确有错误的，人民法院可以判决变更。人民法院判决变更，不得加重原告的义务或者减损原告的权益。但利害关系人同为原告，且诉讼请求相反的除外。
