释义	已满十四周岁不满十六周岁的人，犯故意杀人、故意伤害致人重伤或者死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投毒罪的，应当负刑事责任。已满十四周岁不满十八周岁的人犯罪，应当从轻或者减轻处罚。另外，《刑法》第四十九条规定，犯罪的时候不满十八周岁的人不适用死刑。所以，十六周岁杀人的，构成杀人罪，属于未成年人犯罪，根据具体案情可能被判处有期徒刑或无期徒刑，但不会被判死刑。
