释义	丧偶后婚姻关系就会自动解除。在这种情况下，既不需要行政机关进行确认，也不需要离婚证明，更不需要人民法院进行判决，婚姻关系自然终止。活着的一方可以选择组建新的家庭。但是，再进行婚登记，应当向婚姻登记机关出具原配偶死亡的证明。法律依据：《中华人民共和国民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消灭。死亡宣告被撤销的，婚烟关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
