公民担任人民陪审员,应具备哪些条件

释义

法律主观：

法律规定因犯罪受过刑事处罚及被开除公职的人员不得担任人民陪审员，人大常委会的组成人员，公、检、法、司、安的工作人员和执业律师等人员，不得担任人民陪审员。公民不得同时在两个以上的基层人民法院担任人民陪审员。

法律客观：

《全国人民代表大会常务委员会关于完善人民陪审员制度的决定》第四条公民担任人民陪审员，应当具备下列条件： (1)拥护中华人民共和国宪法； (2)年满23周岁； (3)品行良好、公道正派； (4)身体健康。
