释义	一、本罪主体是特殊主体，即有义务报商检机构检验进出口商品的个人和单位。没有报检义务者不构成本罪。二、本罪主观方面必须是故意，过失不构成本罪。三、“情节严重”的才构成本罪。四、逃避商检的非法行为表现为： (1)对应检和必检进口商品，未经报检擅自在境内使用和销售; (2)对应检、必检商品，未经报检合格即擅自出口; (3)经过商检抽查，认为是不合格商品而擅自出口。因此，认定本罪一个重要界限是看进出口商品是否国家规定的必检、应检商品。由当事人选择可检可不检商品，不构成本罪。要认真审查商检
