释义	法律分析：起诉是第一次到法院提起诉讼，称“打官司”。上诉是不服一审法院的判决和裁定，在规定的时间内向上一级法院申请审理的诉讼活动。其区别是诉讼的法院级别不同，上诉有上一级法院审理。判决的效力不同，上诉后的判决是终审判决，起诉不一定上诉，但上诉一定是起诉后不服，才出现的诉讼行为。法律依据：《中华人民共和国民事诉讼法》第十五条机关、社会团体、企业事业单位对损害国家、集体或者个人民事权益的行为，可以支持受损害的单位或者个人向人民法院起诉。
