释义	两者的法律行为性质不同。遗赠是一种单方法律行为。遗赠人在立遗嘱时，不必征求受遗赠人的同意，即可在其遗嘱中作出遗赠的规定。此遗嘱在遗赠人死亡后即发生法律效力，并不受受遗赠人接受遗赠与否的影响。法律依据: 《中华人民共和国民法典》第一千一百三十三条自然人可以依照本法规定立遗嘱处分个人财产，并可以指定遗嘱执行人。自然人可以立遗嘱将个人财产指定由法定继承人中的一人或者数人继承。自然人可以立遗嘱将个人财产赠与国家、集体或者法定继承人以外的组织、个人。自然人可以依法设立遗嘱信托。
