释义	法律分析：我国对国有资金投资项目的投资控制实行的是投资概算审批制度，国有资金投资的工程原则上不能超过批准的投资概算。国有资金投资的工程实行工程量清单招标，为了客观、合理地评审投标报价和避免哄抬标价，避免造成国有资产流失，招标人必须编制招标控制价，规定最高投标限价。法律依据：《建设工程质量管理条例》第十条建设工程发包单位不得迫使承包方以低于成本的价格竞标，本条规定不应对所编制的招标控制价进行上浮或下调。
