释义	法律分析：对违反国家规定，擅自使用童工者，除责令其立即退回外，可予以重罚。对情节严重、屡教不改者，应责令其停业整顿、直至吊销其营业执照。对诱骗虐待童工的包工头，要提交司法部门依法追究刑事责任。法律依据：《中华人民共和国劳动法》第十五条禁止用人单位招用未满十六周岁的未成年人。文艺、体育和特种工艺单位招用未满十六周岁的未成年人，必须依照国家有关规定，履行审批手续，并保障其接受义务教育的权利。
