释义	三年以上十年以下有期徒刑。组织、领导、参加黑社会性质组织罪，是指组织、领导或者参加以暴力、威胁或者其他手段，有组织地进行违法犯罪活动，称霸一方，为非作歹，欺压、残害群众，严重破坏经济、社会生活秩序的黑社会性质组织的行为。构成积极参加黑社会性质组织罪的，依法可处三年以上七年以下有期徒刑，可以并处罚金或者没收财产。如果不属于积极参加的，则应处三年以下有期徒刑、拘役、管制或者剥夺政治权利，可以并处罚金。
