释义	律师分析：孩子长期随哪一方生活并不是变更抚养权的法定情形。变更子女的抚养权一般是先由双方协商，如果协商不成可以通过法院裁决变更，有下列情形之一的，法院一般会支持变更抚养权的请求：比如说拥有抚养权的一方有严重的疾病或者是伤残，没有办法继续抚养子女的，或者是对子女没有尽到抚养的义务，甚至对子女有虐待暴力行为的。【法律依据】：《中华人民共和国民法典》第一千零七十八条婚姻登记机关查明双方确实是自愿离婚，并已经对子女抚养、财产以及债务处理等事项协商一致的，予以登记，发给离婚证。
