释义	法律分析：工程造价鉴定的申请是当事人对工程价款存在争议，既未达成结算协议，也无法采取其他方式确定工程款的，法院可以根据当事人的申请委托有司法鉴定资质的工程造价鉴定机构对工程造价进行鉴定。认定是当事人诉前已经共同选定具有相应资质的鉴定机构对建设工程作出了相应的鉴定结论，诉讼中一方当事人要求重新鉴定的，一般不予准许。法律依据：根据《关于审理建设工程施工合同纠纷案件适用法律问题的解释》第十六条，当事人对建设工程的计价标准或者计价方法有约定的，按照约定结算工程价款。
