释义	向法院申请离婚时，想要认定婚姻无效可以同时进行申请，如果法院查实婚姻确属婚姻无效范畴内，法院会认定无效婚姻，就不需要再处理离婚的程序了；如果法院认为不符合无效婚姻的条件，将不会被认定为无效婚姻，但是离婚的程序不受影响。【法律依据】《婚姻法》第十条，有下列情形之一的，婚姻无效：（一）重婚的；（二）有禁止结婚的亲属关系的；（三）婚前患有医学上认为不应当结婚的疾病，婚后尚未治愈的；（四）未到法定婚龄的。
