醉驾被判缓刑有什么影响后果 |

法律分析：醉驾被判缓刑有犯罪记录，不能参军、公务员、事业单位，不能出具无犯罪证明，影响子女亲属入党、参军政审等后果。缓刑期间，罪犯应当遵守法律、行政法规，服从监督；按照调查机关的规定报告自己的活动；遵守调查机关关于接待客人的规定；离开市、县或者居住的，应当经调查机关批准。缓刑罪犯参加劳动，应当同工同酬。同时判处附加刑的，依然执行附加刑。有两种情况可以有条件地改变缓刑：一、罪犯在缓刑期间表现良好，不再犯罪，可以在缓刑期满后不执行原判或者缩短缓刑考验期。二、罪犯在缓刑期间犯新罪的，法院应当撤销缓刑，并按照数罪并罚的原则决定处以新的刑罚。

第十八条  精神病人在不能辨认或者不能控制自己行为的时候造成危害结果，经法定程序鉴定确认的，不负刑事责任，但是应当责令他的家属或者监护人严加看管和医疗;在必要的时候，由政府强制医疗。
间歇性的精神病人在精神正常的时候犯罪，应当负刑事责任。
尚未完全丧失辨认或者控制自己行为能力的精神病人犯罪的，应当负刑事责任，但是可以从轻或者减轻处罚。
醉酒的人犯罪，应当负刑事责任。
第一百三十三条  违反交通运输管理法规，因而发生重大事故，致人重伤、死亡或者使公私财产遭受重大损失的，处三年以下有期徒刑或者拘役;交通运输肇事后逃逸或者有其他特别恶劣情节的，处三年以上七年以下有期徒刑;因逃逸致人死亡的，处七年以上有期徒刑。
