租赁合同的风险承担： 一、租赁物的毁损、灭失如果是由出租人自身的过错造成的，出租人应当自己负责; 二、租赁物的毁损、灭失如果是由承租人的过失造成的，由承租人向出租人负损害赔偿责任; 三、租赁物的毁损、灭失如果是由第三人造成的，则第三人向出租人负侵权损害赔偿责任 《合同法》第二百一十八条【正当使用租赁物的责任】承租人按照约定的方法或者租赁物的性质使用租赁物，致使租赁物受到损耗的，不承担损害赔偿责任。
