释义	律师解答：已履行的赠与合同一般是不能撤销的，除非法定撤销的情形出现。法定撤销情形包括：（一）受赠人严重侵害赠与人或者赠与人的近亲属；（二）受赠人对赠与人有扶养义务而不履行；（三）受赠人不履行赠与合同约定的义务【法律依据】：《中华人民共和国民法典》第六百五十八条赠与人在赠与财产的权利转移之前可以撤销赠与。经过公证的赠与合同或者依法不得撤销的具有救灾、扶贫、助残等公益、道德义务性质的赠与合同，不适用前款规定。
