释义	法律分析：口头遗嘱的生效条件：口头遗嘱的订立必须是被继承人处于危急情况下之下，如果不订立的话，也许将会没办法订立；口头遗嘱的订立必须要有两个以上的见证人见证；被继承人没有脱离危险或者脱离危险也没办法定订立书面遗嘱。此时口头遗嘱有效。法律依据《中华人民共和国民法典》第一千一百三十八条遗嘱人在危急情况下，可以立口头遗嘱。口头遗嘱应当有两个以上见证人在场见证。危急情况消除后，遗嘱人能够以书面或者录音录像形式立遗嘱的，所立的口头遗嘱无效。
