释义	缓刑犯不能构成累犯。根据《刑法》第六十五条规定，累犯的构成必须符合下列条件：1、前罪和后罪必须都是故意犯罪;2、前罪和后罪必须都是被判处有期徒刑以上刑罚之罪;3、后罪发生的时间必须是在前罪的刑罚执行完毕或者赦免以后五年内。而缓刑是附条件的不执行刑罚，考验期满原判的刑罚就不再执行了，而不是刑罚已经执行完毕，所以，缓刑犯不属于累犯。法律依据《中华人民共和国刑法》第六十五条、第六十六条、第七十六条
