释义	一方不到庭不是一定可以离婚。如果法院经调解无效，确认感情破裂的，可以准予离婚，如果确认感情尚未破裂的，则不会准予离婚。对于原告无正当理由拒不到庭的，法院会视为撤诉，被告无正当理由拒不到庭的，可缺席判决。法律依据: 《中华人民共和国民法典》第一千零七十九条夫妻一方要求离婚的，可以由有关组织进行调解或者直接向人民法院提起离婚诉讼。人民法院审理离婚案件，应当进行调解；如果感情确已破裂，调解无效的，应当准予离婚。
