释义	对于被胁迫参加犯罪的，应当按照他的犯罪情节减轻处罚或者免除处罚。被胁迫参加犯罪的人，虽然其犯罪是在他人对其施加精神强制下作为的，是违背其意志的，但毕竟其人身并未受到强制，主观上仍有意志自由，只是畏于自身遭到的危险，不敢不参加犯罪，所以其主观上是有罪过的，因此要负刑事责任.但也由于其犯罪是不得已而为之，其危害性小于没受精神强制而实施犯罪的人。法律依据《中华人民共和国刑法》第二十八条【胁从犯】对于被胁迫参加犯罪的，应当按照他的犯罪情节减轻处罚或者免除处罚。
