释义	出轨军人的配偶一般情况下不构成犯罪，不会坐牢。第三者的行为还不能构成破坏军婚罪，只是一般的通奸行为，但如果与之同居或者结婚的，处三年以下有期徒刑道或者拘役。现役军人的配偶要求离婚，须征得军人同意，但军人一方有重大过错的除外。此规定给予军人婚姻以特别的保护。法律依据：《中华人民共和国刑法》第二百五十九条明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条的规定定罪处罚。
