释义	公司没有和劳动者签订劳动合同的，劳动者可以提出辞职报告随时离职，公司不能以此扣押工资，应结清所有拖欠工资以及加班工资。法律依据: 《陪世中华人民共芦嫌肢和国劳动合同法》第八十二条第一款用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。
