释义	法律分析：夫妻一方诉讼离婚是可以撤诉的，如果原告经传票传唤，无正当理由拒不到庭的，也可以按撤诉处理。不过，原告撤诉或者按撤诉处理的离婚案件，没有新情况、新理由，六个月内又起诉的，法院将不予受理。法律依据：《最高人民法院关于适用中华人民共和国民事诉讼法的解释》第二百一十四条原告撤诉或者人民法院按撤诉处理后，原告以同一诉讼请求再次起诉的，人民法院应予受理。原告撤诉或者按撤诉处理的离婚案件，没有新情况、新理由，六个月内又起诉的，比照民事诉讼法第一百二十四条第七项的规定不予受理。
