释义	法律分析：根据《刑事诉讼法》第(261)二百六十一条规定，最高人民法院判处和核准的死刑立即执行的判决，应当由最高人民法院院长，签发执行死刑的命令。被判处死刑缓期二年执行的罪犯，在死刑缓期执行期间，如果没有故意犯罪，死刑缓期执行期满，应当予以减刑的，由执行机关提出书面意见，报请高级人民法院裁定；如果故意犯罪，情节恶劣，查证属实，应当执行死刑的，由高级人民法院报请最高人民法院核准；对于故意犯罪未执行死刑的，死刑缓期执行的期间重新计算，并报最高人民法院备案。
