释义	律师分析：债务有效存在是债务承担的前提，债务自始无效或者承担时已经消灭，即使当事人就此定有承担合同，也不发生效力。被转移的债务应当具有可转移性，第三人须与债务人就债务的转移达成合意，债务承担须经债权人的同意；依照相关法律规定办理批准、登记等手续。【法律依据】：《中华人民共和国民法典》第五百五十一条债务人将债务的全部或者部分转移给第三人的，应当经债权人同意。债务人或者第三人可以催告债权人在合理期限内予以同意，债权人未作表示的，视为不同意。
